OVERVIEW

Welcome to BrandBargain ("we", "us", "our"). We operate this website and store to offer curated digital brand packages - specifically, domain transfers and logo file packs - and related support (the "Services"). By visiting or purchasing from our store, you agree to these Terms and to our Privacy Policy link. If you do not agree, do not use the Services. 

 

1) ACCESS & ACCOUNT

You represent you're the age of majority where you live, and that any information you provide (e.g., billing, contact) is accurate. You're responsible for account security and activity. Accounts may not be sold or transferred. 

 

2) OUR PRODUCTS (DIGITAL)

We sell intangible goods and services: (a) transfer of a domain name to your registrar account, (b) delivery of logo files (in editable and scalable SVG format) and transferred to you as described in these Terms, and (c) guided transfer support. We aim to represent listings accurately, but colors, renders, and mockups can vary by device. We may update or discontinue listings anytime. 

 

3) ORDERS & CANCELLATIONS

Your order is an offer to purchase; we may accept or decline at our discretion. We must receive payment authorization before acceptance. Cancellations are generally possible until delivery/transfer begins (see Section 8 and our Refund & Cancellation Policy). Once logo files are delivered or a domain transfer/push is initiated, sales are typically final except where law requires. 

 

4) PRICES & BILLING (INCLUDING INSTALLMENTS)

Prices may change without notice. Taxes, duties, or other charges are your responsibility unless stated otherwise. If you choose installments/financing at checkout (e.g., Shop Pay Installments (Affirm), Klarna, PayPal Pay Later), you enter a separate agreement with that provider; approvals, schedules, rates/fees, and refunds are handled by the provider. We begin delivery after the provider confirms the purchase. Finance charges already assessed may be non-refundable - review provider terms. You warrant that your payment info is true and authorized. 

 

5) DELIVERY & TRANSFER (NO PHYSICAL SHIPPING)

We do not ship physical items. After payment is secured, we begin digital delivery:

  • Domain transfer by same-registrar push (fastest) or inter-registrar transfer using an auth/EPP code. We'll advise the fastest method.
  • Eligibility (ICANN): domains < 60 days from creation or a prior transfer may be transfer-locked; updating registrant contact can trigger a 60-day lock unless your registrar offers-and you choose-an opt-out.
  • Logo files delivered by download link or by email to your contact address.

Title to the domain passes when it successfully leaves our registrar account for the account you've specified to us. Once completed, the transaction is closed and funds are released. DNS changes and propagation (typically 24-48 hours) are your responsibility unless we agree to assist. 

 

6) INTELLECTUAL PROPERTY; LICENSE & OWNERSHIP

  • Logo transfer: If your purchase includes a logo, then upon payment completion and delivery we transfer the logo design shown on the listing to you for your exclusive use, and provide the associated high-resolution source files (in editable and scalable SVG format).
  • Your rights: You may use, reproduce, display, modify, and create derivative versions of the delivered logo for your business, including for commercial branding and marketing. You may share the files with your employees, contractors, and service providers to support your brand.
  • No resale / no reuse by us: After delivery, we will not resell, license, or reuse the same logo design for another customer as a "brandable logo" for a different domain listing.
  • Third-party materials: Some logo previews may rely on third-party materials (for example, fonts or stock elements). Those third-party rights are not transferred by us and may require separate licensing by you. If any third-party elements apply, we’ll disclose them on the product page and delivery.
  • Our site & tools: The website content, templates, processes, and internal tools we use to create listings remain ours; this does not limit your rights in the delivered logo files described above.

 

7) TRADEMARK & LEGAL CLEARANCE (NO LEGAL ADVICE)

We do not guarantee that a domain or logo is registrable or non-infringing for your specific goods/services or regions. Trademark and other IP clearance is your responsibility. Your domain and logo purchase does not include trademark registration. We recommend consulting qualified counsel before launch or filing. You are responsible for determining suitability and non-infringement for your intended goods/services and regions. (Nothing herein is legal advice.) 

 

8) REFUNDS & EU/UK DIGITAL RIGHTS

Our Refund & Cancellation Policy governs cancellations and refunds.
EU/UK consumers: If you request immediate delivery, you'll be asked to consent to starting supply and acknowledge that you lose the 14-day withdrawal right once delivery begins (digital content/services). If you do not consent, we will wait 14 days to begin and you may cancel during that period. If the service is fully performed during the period, the withdrawal right no longer applies. 9) RELATIONSHIP WITH SHOPIFY

BrandBargain is powered by Shopify, but all purchases are made with BrandBargain, not Shopify. Shopify is not responsible for sales between you and BrandBargain. You expressly release Shopify from claims arising from your purchases.

 

10) PRIVACY

Personal data is processed per our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects/processes information to operate and improve the Services; see Shopify's privacy disclosures. 

 

11) FEEDBACK

If you submit ideas/reviews/feedback, you grant us a worldwide, sublicensable, royalty-free license to use them to operate and improve the Services. You represent you have the rights to provide such content and that it complies with these Terms. 

 

12) ERRORS & CHANGES

We may correct errors or update information (including pricing or availability) at any time without notice, and may cancel orders affected by inaccuracies. 

 

13) PROHIBITED USES

You may not misuse the Services, violate laws, infringe IP, harass others, transmit malware, scrape/spam, or interfere with security or operations. We may suspend or terminate access for violations. 

 

14) TERMINATION

We may terminate access at any time; you remain liable for amounts due through the termination date. Sections that by nature should survive will continue in force. 

 

15) DISCLAIMER OF WARRANTIES

AS IS / AS AVAILABLE. We disclaim all implied warranties to the fullest extent permitted by law, including merchantability, fitness, and non-infringement. We don't warrant uninterrupted or error-free operation. Some jurisdictions limit disclaimers - those limits may apply to you. 

 

16) LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, WE (AND SHOPIFY AND EACH OF OUR RESPECTIVE AFFILIATES, OFFICERS, EMPLOYEES, AND PROVIDERS) ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/GOODWILL/ DATA, ARISING OUT OF OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. 

 

17) INDEMNIFICATION

You agree to defend, indemnify, and hold harmless us and Shopify (and our respective affiliates, officers, employees, and agents) from claims arising out of your breach of these Terms, violation of law or third-party rights, or misuse of the Services. 

 

18) SEVERABILITY

If any provision is unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remainder will stay in effect. 

 

19) WAIVER; ENTIRE AGREEMENT

No waiver of any term is a future waiver. These Terms (plus linked policies) are the entire agreement between you and us regarding the Services and supersede prior agreements. 

 

20) ASSIGNMENT

You may not assign these Terms without our consent. We may assign without consent. 

 

21) GOVERNING LAW; VENUE

These Terms are governed by the laws of the State of Michigan & the United States of America, with venue in the courts where BrandBargain is headquartered. You consent to personal jurisdiction in those courts. 

 

22) HEADINGS

Headings are for convenience only and do not affect interpretation. 

 

23) CHANGES TO TERMS

We may update these Terms by posting a revised version with an updated "Last updated" date. Material changes will be notified as required by law. Continued use after changes constitutes acceptance.
